Claim Identification and File Review: Collection of claimant demographic data required to initiate the settlement proposal process.
Medical Condition Review: We aggressively search to identify the claimant’s medical conditions that may dramatically reduce the insurer’s MSA funding exposure for both Medicare and Non-Medicare eligible needs. We then provide the rated ages to the MSA allocator so that they can accurately prepare the Allocation Report the first time, thus avoiding a future revision that may result in additional costs to the insurer.
MSA Allocation Worksheet: We verify the calculations of the MSA Allocator for accuracy. If our figures show a discrepancy, we contact the Allocator to clarify the figures. This process has saved our clients tens of thousands of dollars in unnecessary MSA funding expense overcharges.
MSA Funding Plan Design: Once we have verified the MSA Allocation Report calculations, we design the annuity plan to fund the eligible Medicare expenses. Our illustration calculates the savings to the insurer by funding the Medicare liabilities with an annuity. We recommend the use of “Temporary Life” annuities as the funding vehicle. This annuity offers the lowest premium and is accepted by CMS.
Indemnity Settlement Options: We calculate the remaining Indemnity exposure and suggest possible settlement options.
Mediation Attendance: We prefer to participate in the mediation or settlement conferences. Having your Structured Settlement Consultant available in person, or telephonically, increases the probability of a successful resolution.
Settlement Agreement Coordination: We work closely with defense counsel to create an accurate settlement document the first time. We will provide counsel with the required Structured Settlement language to include in the Settlement Agreement. We also interact with the MSA Allocator during the CMS approval process to provide any assistance regarding the annuity funding of the MSA.
